What To Do When A Creditor Keeps Calling You...

Advisors at Integrity Financial Services Limited on a daily basis get calls from people telling us that creditors keep calling them and they don't know what to do. So here are the basic steps to take to stop this from happening...

For example...

You get you get a phone call at 8:30pm…

It's from one of your creditors. At first you think it must be a mistake, you know that we've already contacted them on your behalf and explained that your petitioning for your own bankruptcy and we are dealing with your financial affairs..

The person on the phone is demanding payment; they're threatening, "Doorstep collectors, court action and bailiffs, unless you pay more and unless you pay now!"

You get off the phone as soon as you can. You call us immediately as something must have gone wrong.

Our advisors explain that the creditor has had contact off us and a token £1 payment was accepted.

This is not what you expected is it?

How can the creditors be allowed to hassle you when you're making your best efforts to repay them with a token payment that we set up and they agreed until you go to court for your bankruptcy?


Some creditors will never be happy, and may actively continue to chase you for more money, even when it's clear you are paying all you can afford and are taking advice and in a solution with us.


The creditors are within their rights to contact you by phone, as you have provided this phone number to them, and because you have broken your credit agreement with them.

What are your rights?

Let them know you're in touch with us, in a solution ie: bankruptcy, and taking our advice. Ask them politely not to call for extra payments as you have already told them about your circumstances and that they are to speak to us as we are dealing with your financial affairs and have authority to act for you.

What to do?

If a creditor keeps calling…

Set up 'caller ID" on your phone or block numbers from a withheld number. Only answer calls from numbers that you recognise. You are within your rights to do this. However please bare in mind that sometimes Integrity will call from a witheld or private number.

They keep ringing and ringing…

Write to them and ask them to remove your number from their records and correspond in writing only, you can also advise them next time they call that you will not speak to them over the telephone and will only deal with things via letter. You must continue to open all statements and letters from your creditors but you won't have to speak to them by phone anymore.

The phone keeps ringing…

If they become so frequent or are made at inappropriate times you may feel like they're harassing you. Tell them you will report them to the Office of Fair Trading (OFT) if they continue to call, you can report them here: Office of Fair Trading

The mobile phone keeps ringing…

Write to the creditor making them aware that you are reporting them to the OFT.

They still continue to ring…

Make a formal complaint to the OFT detailing the times and frequency of the calls.

They don't call very often now, but when they do, they make constant threats…

Basically take a pinch of salt with what your creditors threaten when they call.

They can threaten you over the phone with all kinds of warnings.

Remember: if they are actually going to do anything, like court action, you will be told formally by a letter, not over the phone.
