We also provide bankruptcy coaching from 6 months before,after and during the bankruptcy (two years on average-assuming an automatic discharch at the 12 month point).

Before bankruptcy provide on-going advice,support and help if harrassed by creditors and provide strategies for reducing/stopping this.

We assist with the compilation and submission of the statement of affairs (a 32 page document).

Advice on the probability of an Income Payment Agreement (Payment of surplus income to the Official Receiver (OR) over 36 months).

We accompany you to the county or combined court.

Assist with the presentation of the bankruptcy petition and go with you before the district judge.

Provide support for the Official Receiver interview

Explain what happens if the OR asks HMRC to set a nil tax code (NT) on your payslip.

If a home owner in negative equity (or where beneficial interest is less than £1000) explain the process of buying back the "beneficial interest" from the Official Receiver.

If a home owner where beneficial interest is £10 000 or more and where a trustee is appointed provide advice on how to pay the beneficial interest to the trustee.

Provide on-going advice help and support of what to do if harrassed by creditors.

I understand I can do bankruptcy myself-why would I need help?
It is true that most debt solutions can be carried out oneself. The only exception is an IVA which must be supervised by a licensed Insolvency Pratitioner.
The bankruptcy forms can be completed by yourself and you can go to court on your own. In our experience when a person decides to go bankrupt they become relieved initially.
As the bankruptcy date gets closer they become more anxious, the night before the bankruptcy date most do not sleep well.
On the bankruptcy day at court anxiety builds as to most people the county or combined court is not familiar. Neither are the administration procedures. Whilst waiting to see a District Judge, images of the court room (as seen on TV) flash through the mind adding to the uncertainty.
Our clients have a different experience.
They are informed at each stage what exactly happens so they are aware what to expect.
This helps to reduce anxiety. The statement of affairs can be daunting to most. We can provided a simple set of questions which can be done over the phone or filled in at home at your own pace.
This enables us to gradually populate your statement of affairs.
We prompt you for important documents well in advance and if they can not be found provide you with strategies on how to obtain copies.
We inform you of progress and how close we are to completing the document.
When the statement of affairs is completed we send you a copy to check you are happy with it.
Up until just before the bankruptcy date we will reflect any change in your circumstances in the statement of affairs.
Meeting a friendly face at court can inspire confidence and help reduce stress. You are guided gently through the process and any questions can be sorted out then and there. The person that attends court with you gives you an idea of the format and the type of questions the judge may ask.
Can't I get free advice for the Citizens' Advice Bureau (CAB) or National Debt Helpline(NDH)?
Yes you can obtain free advice from the CAB or the National Debt Helpline. The service we offer compliments these free services, offering extra help for those that feel they need it.
For a lot of people a guiding hand from the CAB or NDH is sufficient. However, for people who need an increased level of support at times to suit them then the bankruptcy assistance programme we offer may be of interest. Our service is optional.
Is there a fee for your service?
Yes there is. We do charge modest fees to honestly reflect the time we spend with clients. Most clients pay on an affordable monthly plan whilst we assist them (a little like "pay as you go").
As a family firm we would never place undue financial pressure on an individual we would always treat clients fairly.
